This Privacy & Cookie Policy explains how Mr. Buff Inc. (“Mr. Buff,” “House 1316,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit www.house1316.com, use our applications or services, make a purchase, communicate with us, or interact with our affiliated brands and services, including House Thirteen Sixteen / House 1316, Big Boys, Girl Gang, NOW EAI, and Studio1316.
Big Boys and Girl Gang may maintain their own websites or brand experiences. Where a transaction, account, service, communication, or creative workflow is operated by Mr. Buff Inc. or through House 1316 infrastructure, this Policy applies unless a different policy is specifically presented at the point of collection.
1. Information We Collect
Depending on how you interact with us, we may collect:
- Identity and contact information: name, email address, telephone number, billing address, shipping address, and account details.
- Transaction information: products purchased, order history, returns, refunds, exchanges, payment status, delivery information, and customer-service records.
- Payment information: payment method and transaction identifiers. Full payment-card numbers are generally processed by our payment providers and are not intended to be stored directly by House 1316.
- Device and online activity information: IP address, browser type, device identifiers, pages viewed, referring pages, interactions, and similar technical information.
- Communications: emails, support requests, chat conversations, SMS preferences, and other communications with us.
- Creative content: images, logos, text, prompts, files, instructions, and other materials you submit for design, production, editing, or artificial-intelligence services.
- Virtual fitting-room content: photos you take or choose, product selections, fitting-room interactions, and, if you expressly choose an account-saving feature, the fitting photo or profile information associated with your account.
2. How We Use Personal Information
We may use personal information to:
- process orders, payments, deliveries, returns, exchanges, and refunds;
- create and manage customer accounts;
- provide customer service and respond to questions;
- send transactional communications about orders, accounts, security, service status, or support;
- send marketing communications when legally permitted and when the required consent has been obtained;
- operate, secure, debug, improve, and analyze our websites, applications, and services;
- prevent fraud, abuse, security incidents, and unauthorized activity;
- comply with legal obligations and enforce our agreements; and
- provide creative, production, and artificial-intelligence services requested by users.
3. Artificial Intelligence, NOW EAI, and Studio1316
House 1316 may use proprietary artificial-intelligence tools, including NOW EAI, and creative-production services, including Studio1316, to generate, edit, enhance, transform, prepare, resize, optimize, or otherwise process images and other content at a user’s request.
When you submit images, logos, prompts, text, or other files, you instruct us to process those materials as necessary to provide the requested service. Processing may involve House 1316 systems and service providers used to deliver computing, storage, image-generation, editing, or related technical functions.
You retain any rights you already hold in your original submitted content. We do not obtain ownership of your original material merely because it is processed through NOW EAI or Studio1316. You are responsible for ensuring that you have the rights and permissions necessary to submit and use the materials you provide.
4. Virtual Fitting Room, Photos, and Camera
House 1316 may offer a virtual fitting-room experience for Big Boys, Girl Gang, and other eligible House 1316 products. The feature may allow you to take a photo using your device camera, choose an image from your device, use a saved fitting photo when available, or use a base model.
When you choose Take a Photo, your browser or device may request permission to access the camera. Camera access is used only after you initiate the feature and grant permission. House 1316 does not activate your camera merely because you visit the fitting-room page.
Photos and related fitting-room data are used to provide the preview or styling assistance you request, maintain the fitting-room session, support account features you choose, troubleshoot the service, protect against abuse, and transmit the minimum information reasonably necessary to an AI or image-processing provider when that processing is requested.
When you ask NOW EAI a question that can use the active fitting photo—for example, what color, garment, or style would coordinate with the visible outfit—the current photo may be transmitted with your message to an AI service provider, such as OpenAI, so the provider can analyze the image and return the requested styling response. House 1316 does not save a guest fitting photo to a customer profile merely because it is sent for this analysis.
In the current fitting-room implementation, guest photos remain session-based and are not uploaded to the WordPress Media Library for garment generation. A temporary copy may be transmitted to the AI service provider when the customer sends a NOW EAI fitting-room question with an active photo. If a future version offers a saved fitting photo or Fit Profile for account holders, saving will occur only when the customer chooses that feature. A customer may request deletion of stored account photos subject to applicable law and legitimate security, fraud-prevention, or legal-retention requirements.
We do not use a fitting-room photo to identify you through facial recognition or other biometric identification unless we first provide any notice and obtain any authorization required by applicable law. A fitting-room image should not be uploaded unless you have the right and permission to use the image, including when another person appears in it.
Before or at the point where a fitting-room photo is collected or processed, we may provide a short privacy notice with links to this Policy and our Terms. If a third-party image-processing or virtual-try-on provider is connected, that provider may receive the image solely to perform the requested technical service, subject to applicable contractual and legal requirements.
5. SMS and Mobile Messaging
We use Twilio and related systems to support mobile messaging. Messages may include transactional communications such as order updates, account notices, support communications, delivery information, and, in limited cases, marketing or promotional messages where the appropriate consent has been obtained.
Message frequency varies. Message and data rates may apply. You may reply STOP to opt out of applicable recurring SMS messages and HELP for help, subject to the messaging program and carrier capabilities.
Consent to receive marketing text messages is voluntary and is not a condition of purchase. Where marketing consent is required, it will be requested separately through the applicable application, form, or opt-in experience.
We do not sell, rent, or share mobile numbers, SMS opt-in data, or SMS consent with third parties or affiliates for their own marketing or promotional purposes. Mobile information may be disclosed to service providers, such as Twilio, only as reasonably necessary to deliver and operate the messaging service, maintain security, or comply with law.
Consent for one messaging program or brand is not automatically treated as consent for a different promotional program or affiliated brand unless the user separately agrees.
6. Cookies and Similar Technologies
We use cookies, pixels, local storage, and similar technologies to operate our services, remember preferences, understand traffic, measure performance, support security, and evaluate marketing.
Our services may use technologies provided by Google Analytics, Meta Pixel, and TikTok Pixel. These services may receive information about your browser, device, IP address, interactions, and activity on our websites or applications, subject to their own terms and privacy practices.
We do not sell personal information for money. Depending on how advertising technologies are configured and how applicable law defines “sharing,” certain disclosures to advertising or analytics partners may be treated as “sharing” for cross-context behavioral advertising. Where required by law, we will provide applicable privacy choices.
You can control many cookies through your browser settings. Disabling certain cookies may affect site functionality. Where a consent-management tool is presented, you may also use that tool to manage available cookie choices.
7. How We Disclose Information
We may disclose personal information to vendors and service providers that perform services for us, including payment processing, order fulfillment, shipping, hosting, security, analytics, customer support, communications, SMS delivery, and creative or AI processing. These providers receive information only for legitimate business functions and subject to applicable contractual or legal requirements.
We may also disclose information when required by law, court order, legal process, or when reasonably necessary to protect the rights, property, safety, and security of Mr. Buff Inc., our customers, our users, or others.
8. Big Boys and Girl Gang
Big Boys and Girl Gang are affiliated brands within the Mr. Buff Inc. / House 1316 ecosystem. Information may be used across our internal business operations when reasonably necessary to fulfill an order, provide a service, maintain an account, or support a customer. Mobile opt-in data and SMS consent are not transferred between affiliated brands for their own marketing or promotional use without separate consent where required.
9. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to complete transactions, maintain business and tax records, resolve disputes, enforce agreements, provide services, and satisfy legal, security, and operational requirements. Retention periods may vary depending on the type of information and the reason it was collected.
Virtual fitting-room photos are subject to the specific handling described above. Guest-session images are intended to be temporary unless a different retention period is clearly disclosed at the point of collection. Account-linked fitting photos, if the customer chooses to save them, remain associated with the account until deleted by the customer, removed by House 1316 under an applicable retention schedule, or otherwise required by law.
10. Security
We use reasonable administrative, technical, and organizational measures designed to protect personal information. No system, transmission, or storage method can be guaranteed to be completely secure, and we cannot promise absolute security.
11. California Privacy Disclosures
If California privacy law applies to Mr. Buff Inc. and to your information, the categories of personal information we may have collected in the preceding 12 months include identifiers; customer records information; commercial information; internet or other electronic network activity; geolocation information at an approximate level where available from device/network data; audio, electronic, visual, or similar information when you submit media or contact us through supported channels; professional or employment-related information if voluntarily provided for a relevant business interaction; and inferences drawn from activity or preferences used to operate, personalize, secure, or improve our services.
The business purposes for collecting and using these categories are described above, including order fulfillment, customer service, security, analytics, communications, creative/AI processing, and legal compliance. The categories of recipients may include payment processors, shipping and fulfillment providers, hosting and security vendors, analytics providers, communications/SMS providers, and technical providers used to perform requested creative or AI services.
We do not sell personal information for money. Where California law treats certain advertising-technology disclosures as “sharing” for cross-context behavioral advertising, eligible California residents may have the right to opt out where those technologies are used and the law applies.
12. California Privacy Rights
If the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), applies to Mr. Buff Inc. and to your information, California residents may have rights that include the right to know/access, delete, correct, opt out of certain sales or sharing, limit certain uses of sensitive personal information where applicable, and receive equal service without unlawful discrimination for exercising privacy rights.

13. Children’s Privacy

Our websites and applications may link to third-party services. We are not responsible for the privacy practices of third parties, and their own policies apply when you use their services.
