Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of websites, applications, stores, communications, and services operated by Mr. Buff Inc. under House Thirteen Sixteen / House 1316 and, where applicable, affiliated brands and services including Big Boys, Girl Gang, NOW EAI, and Studio1316.

By accessing or using our services, creating an account, placing an order, or requesting creative services, you agree to these Terms and any additional terms presented for a particular service.

1. Business and Affiliated Brands

Mr. Buff Inc. is the legal owner/operator of the House 1316 ecosystem. Big Boys and Girl Gang may maintain separate brand pages or websites, while transactions or services may be processed through shared House 1316 infrastructure.

2. Accounts and Accurate Information

You are responsible for providing accurate, current information and for safeguarding your account credentials. You are responsible for activity performed through your account unless prohibited by law.

3. Orders and Availability

All orders are subject to acceptance, product availability, pricing verification, fraud screening, and payment authorization. We may cancel or limit an order when reasonably necessary because of inventory errors, pricing mistakes, suspected fraud, legal restrictions, or other legitimate operational reasons. If we cancel an order after payment has been captured, we will issue an appropriate refund.

4. Pricing, Taxes, and Payment

Prices are displayed in the currency indicated at checkout and may change without notice before an order is placed. Applicable taxes, shipping, and other charges will be shown where required. Payments may be processed by third-party payment processors subject to their terms.

5. Shipping and Delivery

Delivery dates are estimates unless expressly guaranteed in writing. Carrier delays, weather, customs, incorrect addresses, and events beyond our reasonable control may affect delivery. Risk and responsibility for a shipment are determined by applicable law and the delivery terms presented for the order.

6. Returns and Refunds

Returns, exchanges, damaged-item claims, and refunds are governed by our Refund & Return Policy, which is incorporated into these Terms.

7. Custom Production and Customer Approvals

For custom or made-to-order work, you are responsible for reviewing and approving artwork, spelling, colors, sizes, placement, quantities, and other specifications presented for approval. Production may begin after approval, and changes may not be possible once production starts.

8. Customer Content and Intellectual Property

You may submit logos, photographs, artwork, prompts, text, and other content. You represent that you own the material or have sufficient permission to submit it and authorize its use for the requested service.

You retain rights you already hold in your original content. You grant Mr. Buff Inc. a limited license to host, copy, process, modify, transmit, and use submitted content as reasonably necessary to provide the requested services, fulfill orders, operate the service, and comply with law.

You may not use our services to infringe intellectual-property rights, impersonate others unlawfully, distribute illegal content, or violate applicable law.

9. NOW EAI and Studio1316

NOW EAI and Studio1316 may provide AI-assisted and creative-production functions, including generation, editing, enhancement, transformation, optimization, and preparation of images or other content.

AI-generated or AI-assisted output may contain errors, artifacts, similarities, or unexpected results. You are responsible for reviewing output before relying on it commercially or submitting it for final production. Unless expressly stated otherwise, we do not guarantee that generated output will be unique, registrable as intellectual property, or free of all third-party claims.

10. Virtual Fitting Room and Image Permissions

The House 1316 virtual fitting room may allow you to use a camera, upload or select an image, use a saved fitting photo when available, select a base model, and combine a person image with eligible Big Boys, Girl Gang, or House 1316 products for a visual try-on preview.

You authorize Mr. Buff Inc. and the technical service providers used to operate the feature to process the image and related product data only as reasonably necessary to provide, secure, troubleshoot, and improve the requested fitting-room service, subject to our Privacy & Cookie Policy and any additional notice presented at collection. When you submit a fitting-room question to NOW EAI while an active photo is loaded, the image may be transmitted with your message to the AI provider so it can analyze visible clothing, colors, coordination, and styling relevant to your request.

You represent that you own the image or have permission from every person depicted to use the image for the fitting-room service. You may not upload another person’s photo without permission, use the feature for unlawful impersonation, harassment, exploitation, or deceptive activity, or submit content that violates applicable law or third-party rights.

Try-on results are simulations. They may differ from the actual fit, size, drape, color, texture, proportion, lighting, or appearance of a physical product. Product measurements, descriptions, availability, and applicable size information remain the controlling product information. A preview does not guarantee fit or create a separate return right beyond our posted Refund & Return Policy and applicable law.

If an account-based saved fitting photo or Fit Profile is offered, the customer controls whether to save a photo through the available account controls. Guest-session images are handled as described in the Privacy & Cookie Policy and the notice shown in the fitting-room interface.

11. SMS Terms

House 1316 may send transactional SMS communications and, when separately authorized, recurring marketing or promotional messages through Twilio or another messaging provider.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out of applicable recurring SMS messages and HELP for help. Carriers are not liable for delayed or undelivered messages.

Marketing SMS consent is voluntary and is not a condition of purchase. Consent will be collected separately through the applicable application or opt-in flow where required.

Mobile numbers, SMS opt-in data, and SMS consent are not sold or shared with third parties or affiliates for their own marketing or promotional purposes.

12. Privacy and Cookies

Our Privacy & Cookie Policy explains how we handle personal information, cookies, analytics, advertising technologies, mobile messaging data, and creative-service content.

13. Acceptable Use

You may not attempt to compromise our systems, bypass security, introduce malicious code, scrape or access services in an unauthorized manner, abuse messaging functionality, or use our services for unlawful, fraudulent, harmful, or infringing activity.

14. Service Changes

We may modify, suspend, discontinue, or update features and services when reasonably necessary for security, maintenance, legal compliance, product development, or business operations.

15. Disclaimers

To the maximum extent permitted by law, services are provided on an “as available” basis. We do not warrant uninterrupted operation or that all errors can be prevented. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Mr. Buff Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the services. Any limitation applies only to the extent permitted by law and does not limit rights that cannot legally be waived.

17. Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules, except where consumer law requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time. The effective date above identifies the current version. Continued use after an update may constitute acceptance where permitted by law; additional notice will be provided where legally required.
